1. Acceptance of these terms

These Terms and Conditions (“Terms”) apply to your use of the Jewish House website at https://www.jewishhouse.org.au/ (“Site”), operated by Jewish House, (ABN 19 350 397 588) (“Jewish House”, “we”, “us” or “our”), a registered charity

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. About Jewish House

Jewish House provides crisis accommodation, mental health support, family programs, employment support and afterhours crisis services to the community. Information on this Site about our services is provided for general information purposes.

3. Not a substitute for emergency or professional support

Content on this Site is provided for general information only and is not a substitute for professional medical, psychological or clinical advice. It should not be relied on to make decisions about your health or safety.

If you or someone else is in crisis or immediate danger, please call our 24/7 Crisis Line on 1300 544 357, or 000 in an emergency.

4. Donations and payments

When you make a donation through the Site, you will be directed to our fundraising and payment partner, currently Fundraise Up to process your payment.

As part of making a donation, you may be asked to provide personal information including your name, contact details, billing address and payment details. This information is handled in accordance with our Privacy Policy and the privacy policy of our payment partner.

Jewish House does not store your full payment card details. Our payment partner operates its own website, over which Jewish House has no control, and we make no warranties about that site. Jewish House will not, without your permission or unless required by law, sell or distribute your personal information other than to process your donation and, where relevant, to compile de-identified statistics for fundraising reporting.

All donations processed through the Site are in Australian Dollars, unless otherwise stated by our payment partner.

5. Intellectual property

Unless otherwise indicated, all content on the Site — including text, images, logos and design — is owned by or licensed to Jewish House and is protected by copyright and other intellectual property laws. You may view and download material from the Site for personal, non-commercial use only. You must not reproduce, distribute, modify or publicly display any content from the Site without our prior written consent, except as permitted by law.

6. Third-party materials and links

The Site may include material provided by third parties, or links to third-party websites and services. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party material or website. If you use a third-party service linked from the Site, that service’s own terms and privacy policy will apply, and Jewish House has no responsibility for how that third party handles your information.

7. Acceptable use

You must not use the Site to:

  • publicly perform, broadcast or distribute Site content without permission;
  • attempt to reverse engineer, decompile or disassemble any part of the Site, except as permitted by law;
  • interfere with or disrupt the operation of the Site, or attempt to gain unauthorised access to it; or
  • use the Site for any unlawful purpose.

8. Limitation of liability

To the maximum extent permitted by law, and subject to clause 11 below:

  • Jewish House makes no warranty as to the accuracy, completeness or reliability of any content on the Site, and the Site may contain errors or omissions;
  • Jewish House and its officers, employees, contractors and suppliers will not be liable for any loss or damage arising from your use of, or inability to use, the Site, including any interruption, error or delay;
  • nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded; and
  • where permitted by law, our liability for a breach of any non-excludable guarantee is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

9. Consumer guarantees

Nothing in these Terms is intended to limit any rights you may have under the Australian Consumer Law (or equivalent legislation) that cannot be excluded, restricted or modified by agreement.

10. Indemnity

To the extent permitted by law, you agree to indemnify Jewish House against any loss, damage, cost or expense arising from your breach of these Terms or misuse of the Site, except to the extent caused by our own negligence or wrongful act.

11. Privacy

Our collection, use and disclosure of personal information through the Site is governed by our Privacy Policy, available at www.jewishhouse.org.au/privacy-policy. By using the Site, you agree that you have read and understood our Privacy Policy.

12. Suspension and termination

We may suspend or restrict access to the Site, in whole or in part, at any time and without notice — for example, for maintenance, security, or if we reasonably believe these Terms have been breached.

13. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on the Site, with the “Last updated” date shown above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

14. Survival and severability

Any clause that by its nature is intended to survive termination of your use of the Site will continue to apply. If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of New South Wales.

The Site is operated from Australia. We make no representation that the Site is appropriate for use in other jurisdictions. If you access the Site from outside Australia, you do so at your own risk and are responsible for complying with local laws.
